The first English translation of the major political works of Benjamin Constant (1767-1830), one of the most important of the French political figures in the aftermath of the revolution of 1789, and a leading member of the liberal opposition to Napoleon and later to the restored Bourbon monarchy. The texts included in this volume are widely regarded as one of the classic formulations of modern liberal doctrine.

This paper is about an asymmetry in the justification of praising and blaming behaviour which free will theorists should acknowledge even if they do not follow Wolf and Nelkin in holding that praise and blame have different control conditions. That is, even if praise and blame have the same control condition, we must have stronger reasons for believing that it is satisfied to treat someone as blameworthy than we require to treat someone as praiseworthy. Blaming behaviour which involves serious harm (...) can only be justified if the claim that the target of blame acted freely cannot be reasonably doubted. But harmless praise can be justified so long as the claim that the candidate for praise did not act freely can be reasonably doubted. Anyone who thinks a debate about whether someone acted freely is truth-conducive has to acknowledge that reasonable doubt is possible in both these cases. (shrink)

The first part of this paper surveys five perspectives in Kant’s philosophy on the quantity of retribution to be inflicted on wrongdoers, ordered by two dimensions of difference – whether they are theoretical or practical perspectives, and the quantity of retribution they prescribe: (1) theoretical zero, the perspective of theoretical philosophy; (2) practical infinity, the perspective of God and conscience; (3) practical equality, the perspective of punishment in public law; (4) practical degrees, the perspective we adopt in private relations to (...) others and (5) practical zero, a perspective I argue is entailed by Kant’s doctrine of strict right, which is his justification of coercing compliance with public law. Kant acknowledges 1–4 but not 5. The second part draws on Kant’s account of the burden of proof in criminal law to argue that Kant is wrong to adopt 3 in responding to criminals, and that we ought to adopt 5 instead. (shrink)

Benjamin Barber is one of America's preeminent political theorists. He has been a significant voice in the continuing debate about the nature and role of democracy in the contemporary world. A Passion for Democracy collects twenty of his most important writings on American democracy. Together they refine his distinctive position in democratic theory. Barber's conception of "strong democracy" contrasts with traditional concepts of "liberal democracy," especially in its emphasis on citizen participation in central issues of public debate. These essays (...) critique the "thin representation" of liberal democracy and buttress the arguments presented in Barber's twelve books, most recently in his well-received Jihad vs. McWorld: How Globalism and Tribalism Are Re-shaping the World. In these pieces, Barber argues for participatory democracy without dependence on abstract metaphysical foundations, and he stresses the relationship among democracy and civil society, civic education, and culture. A Passion for Democracy is divided into four sections. In the first, "American Theory: Democracy, Liberalism, and Rights," Barber addresses issues of ongoing relevance to today's debates about the roots of participatory democracy, including individualism vs. community, the importance of consent, and the irrelevance of Marxism. Essays in the second section, "American Practice: Leadership, Citizenship, and Censorship" provide a "strong democracy" critique of American democratic practice. "Education for Democracy: Civic Education, Service, and Citizenship" applies Barber's theories to three related topics and includes his much-discussed essay "America Skips School." The final section, "Democracy and Technology: Endless Frontier or End of Democracy?" provides glimpses into a future that technology alone cannot secure for democracy. In his preface, Barber writes: "In these essays... I have been hard on my country. Like most ardent democrats, I want more for it than it has achieved, despite the fact that it has achieved more than most people have dared to want." In contemporary free will theory, a significant number of philosophers are once again taking seriously the possibility that human beings do not have free will, and are therefore not morally responsible for their actions. Free will theorists commonly assume that giving up the belief that human beings are morally responsible implies giving up all our beliefs about desert. But the consequences of giving up the belief that we are morally responsible are not quite this dramatic. Giving up the belief that (...) we are morally responsible undermines many, and perhaps most, of the desert claims we are pretheoretically inclined to accept. But it does not undermine desert claims based on the sheer fact of personhood. Even in the absence of belief in moral responsibility, personhood-based desert claims require us to respect persons and their rights. So personhood-based desert claims can provide a substantial role for desert in free will skeptics' ethical theories. (shrink)

This book presents a contextual study of the life and work of the Cambridge Platonist Ralph Cudworth (1617-1688). Focusing on the theological basis of Cudworth's ethical philosophy, this book unlocks the hitherto ignored political aspect to Cudworth's ethical philosophy. Through a detailed examination of Cudworth's published works - particularly his voluminous "True intellectual system of the Universe" -, his posthumously published writings, and his 'freewill' manuscripts Benjamin Carter argues that the ethical and political arguments in Cudworth's philosophy develop out (...) of Cudworth's Trinitarian theology. Carter traces the link between Cudworth's trinitarianism and his ethical and political ideas by placing Cudworth's work in the turbulent religious and intellectual context of seventeenth-century England, and the University of Cambridge in particular. I here settle a recent dispute between two rival theories in distributive ethics: Restricted Prioritarianism and the Competing Claims View. Both views mandate that the distribution of benefits and burdens between individuals should be justifiable to each affected party in a way that depends on the strength of each individual’s separately assessed claim to receive a benefit. However, they disagree about what elements constitute the strength of those individuals’ claims. According to restricted prioritarianism, the strength of a claim is determined (...) in ‘prioritarian’ fashion by both what she stands to gain and her absolute level of well-being, while, according to the competing claims view, the strength of a claim is also partly determined by her level of well-being relative to others with conflicting interests. I argue that, suitably modified, the competing claims view is more plausible than restricted prioritarianism. (shrink)

I defend a deontological social contract justification of punishment for philosophers who deny free will and moral responsibility (FW/MR). Even if nobody has FW/MR, a criminal justice system is fair to the people it targets if we would consent to it in a version of original position deliberation where we assumed that we would be targeted by the justice system when the veil is raised. Even if we assumed we would be convicted of a crime, we would consent to the (...) imprisonment of violent criminals if prison conditions were better than the state of nature but deterring enough to prevent the state of nature. Sex differences in reproductive strategy and the sexual division of labor resulted in selection for and maintenance of sexual dimorphism across a wide range of characteristics, including body size, hormonal physiology, behavior, and perhaps spatial abilities. In laboratory tasks among undergraduates there is a general male advantage for navigational and mental-rotation tasks, whereas studies find female advantage for remembering item locations in complex arrays and the locations of plant foods. Adaptive explanations of sex differences in these spatial abilities have focused (...) on patterns of differential mate search and routine participation in distinct subsistence behaviors. The few studies to date of spatial ability in nonindustrial populations practicing subsistence lifestyles, or across a wider age range, find inconsistent results. Here we examine sex- and age-based variation in one kind of spatial ability related to navigation, dead-reckoning, among Tsimane forager horticulturalists living in lowland Bolivia. Seventy-three participants (38 male) aged 6–82 years pointed a handheld global positioning system (GPS) unit toward the two nearest communities and the more distant market town. We find no evidence of sex differences in dead reckoning (p = 0.47), nor do we find any evidence of age-related decline in dead-reckoning accuracy (p = 0.28). Participants were significantly more accurate at pointing toward the market town than toward the two nearest villages despite its being significantly farther away than the two nearest communities. Although Tsimane do show sexual dimorphism in foraging tasks, Tsimane women have extensive daily and lifetime travel, and the local environment lacks directional cues that typically enhance male navigation. This study raises the possibility that greater similarity in mobility patterns because of overlapping subsistence strategies and activities may result in convergence of some male and female navigation abilities. Shortages of life-saving medical resources caused by COVID-19 have prompted hospitals, healthcare systems, and governmentsto develop crisis standards of care, including 'triage protocols' to potentially ration medical supplies during the public health emergency. At the same time, the pandemic has highlighted and exacerbated racial, ethnic, and socioeconomic health disparities that together constitute a form of structural racism. These disparities pose a critical ethical challenge in developing fair triage systems that will maximize lives saved without perpetuating systemic inequities. Here we review (...) alternatives to 'utilitarian' triage, including first-come first-served, egalitarian, and prioritarian systems of allocating scarce medical resources. We assess the comparative advantages and disadvantages of these allocation schemes. Ultimately, we argue that while triage protocols should not exacerbate disparities, they are not an adequate mechanism for redressing systemic health inequities. Entrenched health disparities must be addressed through broader social change. (shrink)

The present study investigated how the magnitude the word blindness suggestion effect on Stroop interference depended on hypnotic suggestibility when given as an imaginative suggestion and under conditions in which hypnosis was not mentioned. Hypnotic suggestibility is shown to be a significant predictor of the magnitude of the imaginative word blindness suggestion effect under these conditions. This is therefore the first study to show a linear relationship between the imaginative word blindness suggestion effect and hypnotic suggestibility across the whole hypnotizability (...) spectrum. The results replicate previous findings showing that highs respond to the word blindness suggestion to a greater extent than lows but extend previous work by showing that the advantage for those higher on the hypnotizability spectrum occurs even in a non-hypnotic context. Negative attitudes about hypnosis may not explain the failure to observe similar effects of the word blindness suggestion in less hypnotizable individuals. (shrink)

One of the leading scholars and academic administrators of his time, Benjamin Jowett was Master of Balliol College as well as Regius Professor of Greek and, for a time, vice-chancellor at Oxford University. Along with his achievements in the area of academic reform, Jowett is remembered for this four-volume translation of Plato's dialogues. Characterising Plato as the 'father of idealism', Jowett reminds readers that while 'he may be illustrated by the writings of moderns … he must be interpreted by (...) his own, and by his place in the history of philosophy'. In this first volume, he includes fourteen early and middle dialogues such as Charmides, Apology, Crito, and Phaedo, each presented with a separate editorial introduction. The apostle Paul deals extensively with gender, embodiment, and desire in his authentic letters, yet many of the contemporary philosophers interested in his work downplay these aspects of his thought. _Christ Without Adam_ is the first book to examine the role of gender and sexuality in the turn to the apostle Paul in recent Continental philosophy. It builds a constructive proposal for embodied Christian theological anthropology in conversation with--and in contrast to--the "Paulinisms" of Stanislas Breton, Alain Badiou, and Slavoj Žižek. (...) Paul's letters bequeathed a crucial anthropological aporia to the history of Christian thought, insofar as the apostle sought to situate embodied human beings typologically with reference to Adam and Christ, but failed to work out the place of sexual difference within this classification. As a result, the space between Adam and Christ has functioned historically as a conceptual and temporal interval in which Christian anthropology poses and re-poses theological dilemmas of embodied difference. This study follows the ways in which the appropriations of Paul by Breton, Badiou, and Žižek have either sidestepped or collapsed this interval, a crucial component in their articulations of a universal Pauline subject. As a result, sexual difference fails to materialize in their readings as a problem with any explicit force. Against these readings, Dunning asserts the importance of the Pauline Adam-Christ typology, not as a straightforward resource but as a witness to a certain necessary failure--the failure of the Christian tradition to resolve embodied difference without remainder. This failure, he argues, is constructive in that it reveals the instability of sexual difference, both masculine and feminine, within an anthropological paradigm that claims to be universal yet is still predicated on male bodies. This chapter offers non-retributive, broadly Kantian justifications of punishment and remorse that can be endorsed by free will skeptics. We lose our grip on some Kantian ideas if we become skeptical about free will, but we can preserve some important ones that can do valuable work for free will skeptics. The justification of punishment presented here has consequentialist features but is deontologically constrained by our duty to avoid using others as mere means. It draws on a modified Rawlsian original position (...) in which we assume we are just as likely to be among the punished when the veil of ignorance is raised as we are to be among those protected by the institution of punishment. The justification of remorse presented here is care-based and draws on the value of sympathizing with people we have wronged, which has a Kantian ground in the duty to take others’ ends as our own. In this pilot study, deliberate practice and competence-based assessment were incorporated into a first-year graduate course on professional issues and ethics. Students responded to challenging simulations of basic ethical situations in therapy before and after the course. Aspects of deliberate practice were incorporated into the course. Student self-report ratings and independent performance ratings blind to timing found improvements in students’ ability to manage basic ethical situations in practice. Pilot evidence suggests competence-based assessment and training have potential use for training students (...) preparing to engage in their first therapy practicum experiences. Additional controlled studies are needed to examine the benefits of competence-based assessment and training. (shrink)

In this paper, I present an argument for a rational norm involving a kind of credal attitude called a quantificational credence – the kind of attitude we can report by saying that Lucy thinks that each record in Schroeder’s collection is 5% likely to be scratched. I prove a result called a Dutch Book Theorem, which constitutes conditional support for the norm. Though Dutch Book Theorems exist for norms on ordinary and conditional credences, there is controversy about the epistemic significance (...) of these results. So, my conclusion is that if Dutch Book Theorems do, in general, support norms on credal states, then we have support for the suggested norm on quantificational credences. Providing conditional support for this norm gives us a fuller picture of the normative landscape of credal states. (shrink)

The aim of this paper is to investigate how alternative land ethics of agricultural stakeholders may help explain recent land use changes. The paper first explores the historical development of the land ethic concept in the United States and how those ethics have impacted land use policy and use of private lands. Secondly, primary data gathered from semi-structured interviews of farmers, ranchers, and influential stakeholders are then analyzed using stakeholder analysis methods to identify major factors considered in land use decisions, (...) priorities of factors of each group, and to define relevant mental models describing each group’s view of the land ethic concept. Results show that these stakeholder groups prioritize land use factors qualitatively differently and possess strikingly different land ethics. It is concluded that shifts in stakeholder land ethics have contributed to recent land use changes. Lastly, we discuss how current agricultural policy sends mixed signals about preferred land use and the potential ramifications based on the different land ethics we’ve described. (shrink)

With the godlike powers of modern technology, just one bad actor can unleash hell on Earth. In the face of this threat posed by technology, some have proposed moral bioenhancement as a solution. Although moral bioenhancement may at first seem like something Christian should support, it is my contention in this paper that there is at least one significant reason for Christians to be cautious in their appropriation of moral bioenhancement technology: it can at best give us a false apatheia, (...) which runs the ironic risk of destroying our ability to make moral progress. His concepts are provocative and his marshalling of related quotations is informative.However, I shall argue with some of his crucial assumptions, in a way that affects the validity of some of Spence’s major conclusions. The latter are that “conscious experience (...) is always temporally postneural activity and thus... ‘caused’ not causal. Our ‘control’ is a sense which may be lost.... Our sense of agency is apparently illusory.”I have, of course, no quarrel with the view that even a fully voluntary act is initiated unconsciously (non-consciously). That condition was in fact demonstrated experimentally by us (Libet et al. 1983) when we found that cerebral neural activity (“readiness potential”) precedes the subject’s awareness of his/her intention or wish to act by at least 350 msec. This applied to fully self-initiated acts that occurred without “pre-planning” by the subject of when to move. (Incidentally, those finding have been replicated by others—see Keller and Heckhansen, 1990 with commentary thereon by Libet 1992, and Wong et al. 1988).However, we also found that conscious intention did precede that actual motor act by about 200 msec. That left open the potentiality for the conscious function to control the outcome of the process that was initiated in the brain unconsciously (see Libet 1985). We have all had the experience of consciously suppressing or vetoing the performance of an urge or intention to act. The 200 msec interval provides sufficient time in which the voluntary process could be stopped, before final activation of the motor area about 50 msec before the act. We were able to show that subjects could veto an act in the 100–200 msec interval before the expected time for the action.Spence dismisses this free will potentiality in the control or veto of a voluntary process. He says: “It is flawed because the ‘decision’ (in consciousness) to act or not to act is itself the ‘result’ of preceding neural activity.” This argument is based on my own evidence that a period of up to 500 msec of cerebral activity is required to produce a conscious sensory experience (Libet 1993, for review).But conscious control of a process is not the same as becoming aware of the volitional intent (Libet 1985, 563–564). Control implies the imposing of a change, in this case after the appearance of the awareness of intention to act. Conscious control may not necessarily require the same neural “time-on” feature that precedes the appearance of awareness per se. There is presently [End Page 95] no directly applicable evidence against the appearance of a conscious control function without prior neural processes specific to its initiation.In short, one cannot cavalierly dismiss the possibility of a conscious free will function on the basis of a belief that such a control function must be itself initiated unconsciously by prior specific neural processes. The argument that conscious free will control is simply a useful delusion must still be regarded as a philosophical belief, not a scientifically demonstrated proposition.Spence goes on to suggest that “Consciousness is necessary for purposeful (intentional) action but it is not the initiator.” But if Spence is consistent in his view that all conscious functions are preceded by specific neural activities that initiate the function, then his putative role for consciousness would have been itself initiated unconsciously. How, then, would consciousness be “performing (purposeful, intentional) actions with subtlety and invention” if it is simply an after-effect of the responsible cerebral process? It would appear that Spence is postulating an active role for consciousness in directing the course of neural activities carrying out purposeful, intentional actions. That is the kind of potentiality I was suggesting must be kept open, but one that Spence dismissed elsewhere as “flawed.”On a technical point: The Grey Walter experiment is cited as evidence for postulated effects of timing, in the “illusion” of self-initiation of an act. Using a new dataset of environmental, social, and corporate governance company ratings for the European market, this article examines whether socially responsible stock selection adds or destroys value in terms of portfolio performance. From 2004 to 2012, we find the following: Negative screens excluding unrated stocks from a representative European stock universe allow investors to significantly outperform a passive investment in a diversified European stock benchmark portfolio. Additional negative screens based on environmental and social scores neither add nor destroy portfolio (...) value, when cut-off rates are not too high. In contrast, governance screens can significantly increase portfolio performance under similar conditions. Thus, investors in the European stock market can do well while doing good. Because of a loss of diversification, positive screens can cause portfolios to underperform the benchmark. This implies that investors should concentrate on eliminating the worst firms. Our results are robust along several dimensions, namely, choice of performance measure, time, test parametrisation, portfolio weighting scheme, approximation of the risk-free rate, and consideration of transaction costs. L. T. Hobhouse (1864–1929) is most familiar today as a leading theorist of British new liberalism. This article recovers and examines his overlooked commentary on the concept and rhetoric of race, which constituted part of his better-known project of advancing an authoritative account of liberal doctrine. His writings during and after the South African War, I argue, represent a prominent effort to cast liberalism as compatible with both imperial rule and what he called ‘the idea of racial equality’. A properly (...) liberal empire, he asserted, would dissolve the colour line. This article traces the arguments Hobhouse advanced to make this claim, and explores his motivations for doing so. I contend that Hobhouse drew on the idiom of race as a form of exclusionary rhetoric, to delegitimise rival accounts of liberal empire and to cast his own as properly cosmopolitan. This recovery, I suggest, offers payoffs for our understanding of both Hobhouse's political thought and, more broadly, the uses of ‘race’ in twentieth-century liberalism. (shrink)

Critiques of transhumanism from Christian theologians and philosophers often focus on the movement’s disdain for the human body. These criticisms are expressed in a number of different ways. Some argue that the transhumanists’ disdain is a new form of Gnosticism, while others argue that it leads to real violence against real human bodies. When such criticisms turn to identify the particular sin of which transhumanism is guilty, they sometimes identify vainglory as the besetting sin, but more often than not pride (...) is the sin named. After all, what is transhumanism – with its various proposals for bringing about the posthuman, which is some future being with capabilities so far beyond the human so as to border on godlike – but the latest iteration of the primal sin of humans wanting to become God on their own terms? -/- While such criticisms are valid, they do not capture the depth of transhumanism’s offense from a Christian perspective. Pride and vanity are indeed two of the deadly sins of transhumanism, but there are others at play as well. Moreover, pride is the root of all sin, so saying that pride is the problem is not necessarily helpful. We must find the particular ways in which pride manifests itself. I will argue that the sin of acedia (sometimes spelled accidie), found in ancient lists of the deadly sins, is a primary sin of transhumanism. In so doing, I hope to contribute to a more complete diagnosis of the transhumanist project from a Christian perspective, and I hope to further show why transhumanism is at odds with Christianity, contra the claims of the Christian Transhumanist Association. It should also be stated up front that this article may raise more questions than it answers. Accordingly, it should be seen as an invitation for further research, not as a definitive assessment of acedia in transhumanism. (shrink)

Research into the neural correlates of consciousness (NCC) aims to identify not just those brain areas that are NCC, but also those that are not. In the received method for ruling out a brain area from being an NCC, this is accomplished by showing a brain area’s content to be consistently absent from subjects’ reports about what they are experiencing. This paper points out how this same absence can be used to infer that the brain area’s content is cognitively inaccessible, (...) in which case we would expect its content to be absent from subjects’ reports whether its content is (phenomenally) conscious or not. If so, such reports cannot count as evidence against that brain area being an NCC, and the received method fails. An alternative method (one suggested in Block, 2007) is considered. (shrink)

In many international commercial contracts, the parties will choose the law governing any future disputes. However, where the parties do not choose a governing law, the prevailing approach in arbitration is to afford arbitrators broad and largely unfettered discretion to choose the law considered most appropriate or most applicable. The uncertainty resulting from this discretion potentially affects the parties' rights and obligations, (...) the performance of their contract, the presentation of their cases, and negotiations undertaken to settle their disputes.In this text, Dr Benjamin Hayward critically reviews the prevailing approach to the conflict of laws in international commercial arbitration. The text adopts a focused and detail-oriented analysis - being based on a study of more than 130 sets of arbitral laws and rules from around the world, and drawing heavily on arbitral case law. Nevertheless, it remains both practical and accessible, taking as its focus the needs and expectations of commercial parties, who are the ultimate users of international commercial arbitration.This text identifies the difficulties that result from resolving conflicts of laws through broad and unconstrained arbitral discretions. It establishes that a bright-line test would be a preferable way to resolve arbitral conflicts of laws. In this issue, Greer Donley, Sara Chandros Hull, and Benjamin E. Berkman explore the implications of using whole genome sequencing in the prenatal context. They focus on how whole genome sequencing may refine pregnancy expectations, impact child‐rearing decisions, and foreclose children's desire not to know more about their future. Their paper inspired me to reimagine the predominant worldviews of genomics prediction. One worldview is characterized by woe: the world as we know it will be forever changed unless we avoid (...) the perils of genomics. I found myself thinking of this as the Eeyore phenotype. The Tigger phenotype is a worldview characterized by confidence: the world as we know it is forever changed, and we should embrace our genomic future. Donley, Hull, and Berkman adopt a new phenotype, one that perhaps resembles Christopher Robin. This worldview is characterized by its commitment to moving forward, nurturing relationships, and deliberating thoughtfully: it applies the evidentiary model to whole genome sequencing. Like Christopher Robin, who accepted that growing up was inevitable, the authors appreciate that progress is inevitable. Their response is to offer recommendations for research that might help the Eeyores and Tiggers find common ground. (shrink)

Michael Lamb’s recent book A Commonwealth of Hope presents an opportunity for bioethicists to engage in critical self-evaluation in order to consider anew why and how to engage difficult bioethical problems and questions with those who maintain diverse moral and metaphysical perspectives. Drawing on an account of the virtue of hope from Augustine of Hippo, Lamb develops a political theory in which hope provides common ground for political cooperation between diverse citizens of a commonwealth. The purpose of this introduction is (...) to sketch out a framework by which to assess and evaluate whether bioethics demonstrates hope. This article provides a summary description of Lamb’s presentation of Augustine’s virtue of hope and his concept of politics. Then it considers implications of Lamb’s politics of hope for bioethics, identifying three features of hopeful bioethics, with which bioethicists can engage in self-reflection and evaluation. (shrink)
